The sudden emergence of the COVID-19 pandemic led to dramatic changes in the work of investigation teams and in-house compliance professionals, especially due to the restrictions on global travel. Christopher David of Wilmer Hale examines these challenges, some of which are welcome developments that will continue after the pandemic is contained.

For example, David notes that misconduct investigations have become more difficult due to increased pressure and opportunities for fraud, and the diaspora of workers to remote locations. Evidence collection and review requires different methods when done remotely, with additional wrinkles about chain of custody for forensic data. Interviews must be conducted differently, which is complicated when sensitive information needs to be kept secure over remote communications. Post-investigation engagement with other governments is complicated in similar ways, and remediation such as training is more difficult to execute.
