Topic: “Buy (More) American: The Ongoing Evolution of Buy American Requirements”

The Acquisition Reform and Emerging Issues Committee is pleased to host a discussion of the rapidly evolving landscape for Buy American requirements in public contracting. Contractors and procurement officials are still digesting significant changes to the Buy American Act contract clauses implemented at the very end of the Trump Administration, while facing the prospect of further and more drastic changes as the Biden Administration seeks to put its own stamp on the Buy American Act and other domestic preference programs.

Our discussion will address practical issues arising from recent Trump-inspired changes to the Buy American Act contract clauses and will look ahead to further changes that loom under the Biden Administration, including a possible sea-change in how domestic content is calculated under the Buy American Act. We will also address how the United States’ obligations under foreign trade agreements may impact the current trend toward increased domestic preferences in U.S. government procurements, and whether current government efforts to address disruptions in the supply chains for critical or essential materials may result in additional domestic preferences.
