The federal procurement system provides benefits for small and disadvantaged businesses, such as the ability to compete for set-aside procurements, receive sole-source awards, and access assistance through such programs as the 8(a) Business Development Program or the Small Business Administration’s Mentor-Protégé Program. The statutes and complex rules and regulations governing this system have recently undergone many important changes—as Crowell has previously addressed in blog posts covering SBA’s rulemaking on the consolidation of its mentor-protégé programs and the SBA Rule implementing a one-year extension for 8(a) BD status—with more changes anticipated this year as required by the National Defense Authorization Act for Fiscal Year 2021.
