Section 889 of the FY2019 National Defense Authorization Act has been seen as a significant change to Federal procurement and financial assistance, and it impacts every contractor and Federal award recipient working with the federal Government.  Known as the Prohibition on Certain Telecommunications and Video Surveillance Services or Equipment, contractors are prohibited from selling or using certain Chinese-made telecommunications equipment or services, while recipients are restricted from using loan or grant funds to obtain covered telecommunications equipment or services.  This prohibition was put into place to prevent cyberattacks and exfiltration of sensitive information and intellectual property by foreign adversaries; however, as industry awaits the final rule, the prohibition continues to raise questions.
