- Appeal – The petitioner appealed SBA’s decision to terminate the petitioner’s participation in the 8(a) Business Development program. SBA found the termination was warranted because the petitioner failed to prove that it was owned and controlled by one or more disadvantaged individuals. The petitioner argued that SBA did not offer it advice, feedback, or recommendations for correcting the final revised Social Disadvantage Narrative.
- Decision – OHA denied the appeal. SBA had expressly warned the petitioner of termination if the petitioner did not establish the owner’s individual social disadvantage within 30 days. The petitioner failed to provide any authority to support its argument that SBA should have provided the petitioner with guidance or advice for redrafting the document.
