GAO Dismissed a Protest Because the Protester Had Been Suspended. Could the Protester Revive the Protest When the Suspension Was Lifted?

GAO dismissed a bid protest because the protester was a suspended contractor. The protester asked GAO to reconsider the dismissal after the suspension was lifted. But GAO denied the request, finding the protester had not alleged an error in the decision.

  • Request - GAO previously dismissed the requester's protest finding that the requester, as a suspended contractor, was not an interested party. The requester requested reconsideration stating it was no longer suspended or debarred.
  • Decision - GAO noted that its decision was issued before the protester's suspension had been lifted. The requester therefore did not allege any error in GAO's decision. Consequently, GAO denied the request for reconsideration.
