The FAR Council has released a class deviation for the overhaul of FAR Part 33, Protests, Disputes, and Appeals. The class deviation memorandum states that Part 33 has been updated “to reflect administrative priorities to reduce protests at the lowest level possible.” Among other revisions, the FAR Council has added a new purpose statement to Part 33, which emphasizes that the protest process “is not intended as a way for offerors to get additional insight or to be used by incumbents to delay contract transition.” The Council has also added additional requirements for agency protests. The revision removes a section governing the contracting officer’s duties on appeal to a Board of Contract Appeals, stating that the Board’s procedural rules govern those duties.
