On March 10, Judge Ali issued a preliminary injunction against the government. Judge Ali found it likely that Plaintiffs would prevail on claims that the government violated the Administrative Procedures Act by freezing funding and improperly stopping/suspending work and terminating award. The judge also found the government likely violated the Constitution’s separation of powers by contravening Congress’s spending authority.

Based on these preliminary findings, Judge Ali ordered the Government to make at least 300 payments per day for work performed prior to February 13.
