Senator Mike Lee has introduced a bill that would eliminate race-, ethnicity-, and sex-based preferences across federal contracting programs. This bill would end the SBA’s 8(a) Business Development Program’s socially and economically disadvantaged preferences, the Women-Owned Small Business (WOSB) contracting program, and disadvantaged business enterprise (DBE) goals in DOT-funded transportation and airport projects. The Minority Business Development Act of 2021 would be fully repealed.
The bill also prohibits executive agencies from factoring race, ethnicity, or sex into contract and award decisions — and from imposing such requirements on prime contractors flowing down to subcontractors. Agencies would have 60 days to propose conforming rule changes and 180 days to finalize them.
HUBZone and service-disabled veteran-owned small business preferences would remain intact.
