In 2021, the US Department of Labor (DOL) issued groundbreaking cybersecurity guidance affecting employee benefit plans and immediately began conducting investigations on the topic. Although almost a year has passed, plan sponsors, ERISA fiduciaries, recordkeepers, and other service providers continue to grapple with understanding the DOL’s expectations and the practical challenges of implementing the guidance.
In this joint panel program, attorneys from Morgan Lewis will review the guidance from a legal perspective, and FTI Consulting professionals will discuss what it means from a cybersecurity expert’s point of view. The panelists will then engage in dialogue concerning considerations in implementing the guidance and responding to DOL investigations and cybersecurity incidents.
This dialogue will not be limited to single employer retirement plans. The panelists will also address the unique issues confronting multiemployer plans, multiple employer plans, and pooled employer plans.
