Organizational conflicts of interest (OCI) are a highly consequential and frequently misunderstood area for government contractors.

OCIs can emerge in a variety of contexts — proposals, performance, M&A transactions, hiring, and more — and they do not lend themselves to one-size-fits all analyses or solutions.  The legal risks that can be implicated by OCIs include proposal rejection, bid protests, breach of contract, and potential False Claims Act liability, making it crucial to understand both what gives rise to an OCI and how to navigate them.

During this program, we will refresh on the basics of OCIs, clear up some of the most common misconceptions about them, talk about which mitigation strategies work and which do not, and highlight the latest trends and developments.
